If you continue to live in your New York home during the summer months, can you still change your domicile to Florida?

 
DOMICILE
  • A place which an individual intends to be his permanent home and the place to which he intents to return whenever he may be absent.

  • Each person can only have one domicile.

  • If he has more two or more homes, the domicile is the one which is regarded and used as the permanent home.
  • Burden upon the person asserting a change of domicile to show intention to change domicile by clear and convincing evidence.

  • Whether the place of habitation is the permanent home of a person with a range of sentiment, feeling and permanent association with it.
